1. Introduction

This Privacy Policy describes how Concierge Care, Inc., doing business as Concierge Care Advisors (“Company,” “we,” “our,” or “us”) collects, uses, discloses, and protects your information when you access our website, use the Concierge Care Senior Navigator application, or engage with our services (collectively, the “Services”).

Concierge Care Advisors is a registered trade name of Concierge Care, Inc.

By using our Services, you acknowledge that you have read and understand this Privacy Policy. If you do not agree, please discontinue use of the Services.

2. Information We Collect

2.1 Personal Information

We may collect personal identifiers including name, mailing address, phone number, email address, and other contact details.

2.2 Consumer Health Data

We may collect health-related information that may qualify as “consumer health data” under applicable law, including Washington’s My Health My Data Act.

For purposes of this Policy, consumer health data means personal information that is linked or reasonably linkable to an individual and that identifies past, present, or future physical or mental health status.

Examples may include health conditions, diagnoses, medications, functional limitations, care preferences, and information provided by caregivers or authorized representatives.

2.3 Technical and Usage Data

We may collect technical data such as IP address, browser type, device identifiers, cookies, session behavior, interaction data, and usage analytics.

3. How We Collect Information

We collect information directly from you through forms, chats, emails, calls, and in-app data entry; automatically through cookies and analytics tools; and from authorized caregivers or representatives.

4. How We Use Information

We use collected information to provide personalized care recommendations, generate cost estimates, match users with care providers, improve Services, communicate updates, and comply with legal obligations.

The Service may use automated systems, including artificial intelligence tools, to analyze user-provided information and generate recommendations. These tools provide decision-support only and do not constitute medical advice.

We may use anonymized or de-identified information for analytics, research, and business improvement purposes. We apply reasonable safeguards consistent with HIPAA Safe Harbor de-identification principles and do not attempt to re-identify such data.

5. Sharing and Disclosure

We do not sell identifiable personal information or identifiable consumer health data.

We may share identifiable information with contracted service providers, care providers with explicit consent, when required by law, or in connection with a merger, acquisition, or business transfer.

You may withdraw consent at any time by contacting us. Withdrawal will not affect processing conducted prior to withdrawal.

6. Cookies and Tracking

We use cookies and similar technologies to enhance user experience and analyze website performance. You may disable cookies in your browser settings, though some functionality may be limited.

7. Your Rights

You may request access to, correction of, or deletion of your personal or consumer health data, or withdraw consent for processing, by contacting privacy@conciergecareadvisors.com.

8. Washington Residents

Washington residents may have additional rights under the My Health My Data Act, including the right to confirm data collected, withdraw consent, and request deletion.

We do not sell identifiable consumer health data. We may license de-identified information in compliance with applicable law.

9. California Residents

California residents may exercise rights under the California Consumer Privacy Act (CCPA), including rights to access, correct, or request deletion of personal information.

10. Data Retention

Active account data is retained while active and for three (3) years following last interaction. Health-related information may be retained for seven (7) years unless legally required otherwise. Deletion requests are processed within thirty (30) days, except where retention is legally required.

11. Security

We implement reasonable administrative, technical, and physical safeguards to protect information. However, no method of transmission over the internet is completely secure.

12. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect information from children.

13. Updates to This Policy

We may update this Privacy Policy periodically. Continued use of the Services constitutes acceptance of updates.

Terms of Service

1. Acceptance of Terms

These Terms of Service are between you and Concierge Care, Inc., doing business as Concierge Care Advisors (“Company,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms and our Privacy Policy.

2. Description of Service

The Service provides informational and decision-support tools related to senior care planning. The Service does not provide medical, financial, legal, or insurance services.

3. No Professional Advice

The Service does not provide medical advice, diagnosis, treatment, financial advice, legal advice, or insurance advice. No professional relationship is created.

4. AI and Automated Systems

The Service uses artificial intelligence and automated systems to generate recommendations. Outputs depend on information provided by users and are informational only.

5. User Responsibility

You are solely responsible for decisions made based on information obtained through the Service.

6. Eligibility

You must be at least 18 years old and located in the United States to use the Service.

7. User Content License

You grant the Company a non-exclusive license to use and process submitted content to operate and improve the Service.

We do not sell identifiable personal or health information. We may use de-identified data consistent with applicable law.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of Liability

Total liability arising from use of the Service shall not exceed the greater of $100 USD or the amount paid in the preceding 12 months.

10. Arbitration

Any disputes shall be resolved through binding arbitration in Washington State. Class actions are waived.

11. Governing Law

These Terms are governed by the laws of the State of Washington.

Personal Information Protection Policy

At Concierge Care Advisors, we are committed to providing our users with exceptional service. As providing this service involves the collection, use and disclosure of some personal information about our users, protecting their personal information is one of our highest priorities.

We will inform our users of why and how we collect, use and disclose their personal information, obtain their consent where required, and only handle their personal information in a manner that a reasonable person would consider appropriate in the circumstances.

This Personal Information Protection Policy, in compliance with PIPA, outlines the principles and practices we will follow in protecting our users’ personal information. Our privacy commitment includes ensuring the accuracy, confidentiality, and security of our users’ personal information and allowing our users to request access to, and correction of, their personal information.

Definitions

Personal Information –means information about an identifiable individual. Personal information does not include contact information (described below).

Contact information – means information that would enable an individual to be contacted at a place of business and includes name, position name or title, business telephone number, business address, business email or business fax number. Contact information is not covered by this policy or PIPA.

Privacy Officer – means the individual designated responsibility for ensuring that Concierge Care Advisors complies with this policy and PIPA.

Policy 1 - Collecting Personal Information

1.1 : Unless the purposes for collecting personal information are obvious and the user voluntarily provides his or her personal information for those purposes, we will communicate the purposes for which personal information is being collected, either orally or in writing, before or at the time of collection.

1.2 : We will only collect user information that is necessary to fulfill the following purposes:

  • To verify identity;
  • To identify user preferences;
  • To deliver requested products and services
  • To enroll the client in a program;
  • To send out association membership information;
  • To ensure a high standard of service to our users;
  • To meet regulatory requirements;
  • To contact the user (if requested) via the information provided

Policy 2 - Consent

2.1 : We will obtain user consent to collect, use or disclose personal information (except where, as noted below, we are authorized to do so without consent).

2.2 : Consent can be provided directly or it can be implied where the purpose for collecting using or disclosing the personal information would be considered obvious and the user voluntarily provides personal information for that purpose.

2.3 : Consent may also be implied where a user is given notice and a reasonable opportunity to opt-out of his or her personal information being used for mail-outs, the marketing of new services or products, fundraising and the user does not opt-out.

2.4 : Subject to certain exceptions (e.g., the personal information is necessary to provide the service or product, or the withdrawal of consent would frustrate the performance of a legal obligation), users can withhold or withdraw their consent for Concierge Care Advisors to use their personal information in certain ways. A users decision to withhold or withdraw their consent to certain uses of personal information may restrict our ability to provide a particular service or product. If so, we will explain the situation to assist the user in making the decision.

Policy 3 – Using and Disclosing Personal Information

3.1 : We will only use or disclose user personal information where necessary to fulfill the purposes identified at the time of collection or for a purpose reasonably related to those purposes such as:

  • To contact our users directly about products and services that may be of interest;

3.2 : We will not use or disclose user personal information for any additional purpose unless we obtain consent to do so.

Policy 4 - Retaining Personal Information

4.1 : If we use user personal information to make a decision that directly affects the user, we will retain that personal information for at least one year so that the user has a reasonable opportunity to request access to it.

4.2 : Subject to policy 4.1, we will retain user personal information only as long as necessary to fulfill the identified purposes or a legal or business purpose.

Policy 5 - Ensuring Accuracy of Personal Information

5.1 : We will make reasonable efforts to ensure that user personal information is accurate and complete where it may be used to make a decision about the user or disclosed to another organization.

5.2 : Users may request correction to their personal information in order to ensure its accuracy and completeness. A request to correct personal information must be made in writing and provide sufficient detail to identify the personal information and the correction being sought.

Policy 6 - Securing Personal Information

6.1 : We are committed to ensuring the security of user personal information in order to protect it from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks.

6.2 : The following security measures will be followed to ensure that user personal information is appropriately protected:

  • Secure transmission of data;
  • Appropriate encryption of stored data;

6.3 : We will use appropriate security measures when destroying user's personal information such as shredding printed documents or securely erasing digital information.

6.4 : We will continually review and update our security policies and controls as technology changes to ensure ongoing personal information security.

Policy 7 – Providing Users Access to Personal Information

7.1 : Users have a right to access their personal information, subject to limited exceptions.

7.2 : A request to access personal information must be made in writing and provide sufficient detail to identify the personal information being sought.

7.3 : Upon request, we will also tell users how we use their personal information and to whom it has been disclosed if applicable.

7.4 : We will make the requested information available within 30 business days, or provide written notice of an extension where additional time is required to fulfill the request.

7.5 : A minimal fee may be charged for providing access to personal information. Where a fee may apply, we will inform the user of the cost and request further direction from the user on whether or not we should proceed with the request.

7.6 : If a request is refused in full or in part, we will notify the user in writing, providing the reasons for refusal and the recourse available to the user.
